Caregiver Leave

Under the Ontario Employment Standards Act, 2000, employees are eligible to take a job protected leave to care for or support for certain family members, including a child, spouse, sibling, parent, or dependent family member, if they are ill or injured, or in urgent circumstances. There are various types of job protected leaves, including:

  • Family Caregiver Leave (up 8 weeks);
  • Family Medical Leave (up to 28 weeks);
  • Critical Illness Leave (up to 37 weeks for a child or up to 17 weeks for adult family members)
  • Family Responsibility Leave (up to 3 days)

Additionally, under the Ontario Human Rights Code, employees may be eligible for additional time off to care for a child, spouse, or parent. 

Employers are prohibited from terminating an employee or otherwise penalizing the employee because s/he requires a job protected leave of absence.
